Our Terms and Conditions

The following terms and conditions apply to all products and services provided by SISU Marketing. All work is carried out by SISU Marketing on the understanding that the client (“you” hereafter) has agreed to SISU Marketing’s terms and conditions.



SISU Marketing will provide you with a written quotation. If you wish to proceed, we require a payment on account of 50% of the quotation, prior to work commencing. If it becomes apparent that we will need to provide additional services to those included in the quotation in order to meet you requirements, further quotations will be provided to you and we would seek your approval prior to any additional charges being made. Should we be required to work outside normal working hours, including at the weekend or on bank holidays, to complete the project within a specific deadline, we reserve the right to charge an increased hourly rate for this time. We charge 1.5 times our normal fees outside the hours of 9am – 5.30pm on week days and 2 times our normal fees on weekends and all bank holidays. We will inform you in advance if the deadline you have set us will necessitate out of hours work.



Payments may be made by electronic funds transfer. Invoices will be issued by SISU Marketing and should be settled within 30 days of the date of invoice. Accounts which remain outstanding for more than 24 hours after the date of invoice will incur an extra charge of 5% per day of the outstanding amount. If payment is in relation to a web project, SISU Marketing reserve the right to disconnect your website until payment is made.


An account shall be considered to be in default if it remains unpaid for more than 30 days from the date of invoice. SISU Marketing shall be entitled to remove SISU Marketing and/or your material from any and all computer systems until the amount due has been fully paid. This includes any and all unpaid monies due for services, including, but not limited to, hosting, domain registration, search engine submission, design and maintenance,sub-contractors, printers, photographers and libraries.

Removal of such materials does not relieve you of your obligation to pay the due amount. Accounts remaining in default agree to pay SISU Marketing reasonable legal expenses and third party collection agency fees in the enforcement of these terms and conditions.



By supplying text, images and other data to SISU Marketing for inclusion in your website or other medium, you declare that it holds the appropriate copyright and/or trademark permissions. The ownership of such materials will remain with you, or rightful copyright or trademark owner. By supplying images, text, or any other data to SISU Marketing, you grant us permission to use this

material freely in the pursuit of the design. Any artwork, images, or text supplied and/or designed by SISU Marketing on behalf of you, will remain the property of SISU Marketing and/or its suppliers. Should you or SISU Marketing supply an image, text, audio clip or any other file for use in a website, multimedia presentation, print item, exhibition, advertisement or any other medium believing it to be copyright and royalty free, which subsequently emerges to have such copyright or royalty usage limitations, you will agree to allow SISU Marketing to remove and/or replace the file on the site. You agree to fully indemnify and hold SISU Marketing free from harm in any and all claims resulting from you not having obtained all the required copyright, and/or any other necessary permissions.



You agree that changes required over and above the estimated work or required to be carried out after acceptance of the draft design will be liable to a separate charge. You also agree that SISU Marketing accepts no responsibility for any amendments made by any third party, before or after a design is published.



Text is to be supplied to SISU Marketing in electronic format as standard text (.txt), MS Word (.doc) or via email. Images which are supplied in an electronic format are to be provided in a format as prescribed by SISU Marketing via email. Images must be of a quality suitable for use without any subsequent image processing and SISU Marketing will not be held responsible for any image quality which you later deem to be unacceptable. SISU Marketing cannot be held responsible for the quality of any images which you wish to be scanned from printed materials.

Additional expenses may be incurred for any necessary action, including, but not limited to, photography and art direction, photography searches, media conversion, digital image processing, or data entry services. You would be informed of this in advance.



Estimated project duration should be deemed to be from the date that cleared funds are received by SISU Marketing for the initial payment or by date confirmed in writing by SISU Marketing. We will endeavour to get all work completed within the agreed timeframe.


You agree to allow SISU Marketing all necessary access to computer systems and other locations, as required, in order to complete a website project and until all due funds are cleared, including the necessary read/write permissions, usernames and passwords. You also agree to allow SISU Marketing access to any computer systems, usernames and passwords required to remove data and/or sites

for failure to comply with these terms and conditions. You agree to supply SISU Marketing with all necessary materials, electronic, or otherwise, required to create and complete the project, and to supply them in a timely manner.


Following the completion and your approval of your website, a review period of 14 days will follow. Should it transpire that you require amendments to the website, SISU Marketing will make one set of minor changes at no extra cost within 14 days of the start of the review period. Minor changes include small textual changes and small adjustments to placement of items on the page. They do not include changes to images, colour schemes or any navigation features. Any minor changes can be notified to SISU Marketing by email.



SISU Marketing does not offer in-house hosting services. We can only suggest possible sub-contractors and does not guarantee continuous service and will accept no liability for loss of service, whatever the cause. SISU Marketing may suggest that you change the type of hosting account used if that account is deemed by SISU Marketing to be unacceptable because of poor service, lack of bandwidth or in any other way insufficient to support the website. Fees due to the hosting organisation are the responsibility of you, and SISU Marketing are not liable for their payment. At your request, we will endeavour to register a domain name on your behalf. However, SISU Marketing cannot guarantee the availability of any domain name.


Due to the infinite number of considerations that search engines use when determining a site’s ranking, SISU Marketing cannot guarantee any particular placement. Acceptance by any search engine cannot be guaranteed and when a site is accepted, the time it takes to appear in search results varies from one search engine to another. Rankings will also vary as new sites are added.



We respectfully ask that you allow SISU Marketing to place a small credit on printed material, exhibition displays, advertisements and/or a link to SISU Marketing’s own website on your website, usually in the form of a small logo or line of text placed towards the bottom of the page. We also ask that you agree to allow SISU Marketing to place websites and other designs, along with a link to your site on SISU Marketing’s own website for demonstration purposes and to use any designs in its own publicity.



SISU Marketing will not include in its designs, any text, images or other data which it deems to be immoral, offensive, obscene or illegal. All advertising material must conform to all standards laid down by all relevant advertising standards authorities.


SISU Marketing will require written notification of any cancellation of order(s) to You will then be invoiced for all work completed to date.


SISU Marketing makes no warranties of any kind, express or implied, for any and all products and/or services that it supplies. SISU Marketing will not be held responsible for any and all damages resulting from products and/or services it supplies. SISU Marketing is not responsible for any loss, or consequential loss of data, or non-delivery of products or services, whatever the cause. While we

take reasonable steps to investigate the materials we recommend, we accept no responsibility for the performance or quality of materials or any consequential loss arising from their failure. You agree not to hold SISU Marketing responsible for any such loss or damage. Any claim against SISU Marketing shall be limited to the relevant fee(s) paid by you. SISU Marketing reserves the right to use the services of sub-contractors, agents and suppliers and any work, content, services and usage is bound by their terms and conditions. SISU Marketing will not knowingly perform any actions to contravene these and you also agree to be so bound. SISU Marketing and you agree to comply with printers terms and conditions which include disclaimers for non-completion on time and the flexibility to supply quantities within 10% of the total ordered. SISU Marketing recommends that if an exact quantity is required, then 10% extra is added to the quantity and extra time made available should the job be delayed.


All quotations given by SISU Marketing will be valid for 3 months from the date of quotation,
